A judge has blocked a legal challenge against a biomass power plant in central Wisconsin. Marathon County Judge Mike Moran said opponents of the biomass power plant near the Domtar paper mill in Rothschild missed the deadline in June for filing the lawsuit by five days. “The petitioners had a strict deadline of June 16th for their review petition, and they missed it,” Moran said Thursday, also dismissing the lawsuit because it was filed by an attorney who is not licensed to practice law in Wisconsin. “If the rules are to be meaningful, they are to be unbending.”
An attorney for the opponents says he hasn’t had time to talk with his clients about a possible appeal. The lawsuit had challenged the Wisconsin Department of Natural Resource’s decision to grant air permits for the project, claiming there was not enough of a thorough environmental review.
