A state appeals court hands recall forces a victory. Waukesha County Judge Mac Davis last month ordered the Government Accountability Board to take steps to remove potentially false and duplicative signatures from the recall petitions against Governor Scott Walker, the lieutenant governor, and four Republican state Senators.
But the appeals court rules that Davis erred in barring the committees seeking those recalls from participating in the case. The decision by the three judge appeals panel sends the decision back to Davis, whose original decision stemmed from a suit from the state Republican Party, which said it was the GAB’s responsibility – and not that of the candidates – to weed out the suspect signatures.
A spokesman for the GAB says the agency will discuss the appeals court ruling in closed session at its meeting on Tuesday.
