A founding member of The Eagles has settled a lawsuit he filed against a Wisconsin-based apparel retailer, which alleged trademark infringement.
Don Henley filed suit last October in federal court, after the Duluth Trading Company of Belleville advertised a pullover shirt it called the “Henley.” The ad told shoppers to “Don a Henley, and take it easy.” It was a play on Henley’s name and his group’s breakout hit in the early 1970s, “Take It Easy.”
Documents were filed this week in federal court, showing that the company agreed to never again use or imply Don Henley’s name in selling the shirt.
Duluth Trading also apologized to Henley on its website, and made a donation to a non-profit group that Henley started.
