Republican candidate for governor, Mark Green, says he's not surprised at all by a brief filed today by the state Justice Department. The DOJ is asking the Wisconsin Supreme Court to ignore Green's appeal of a State Elections Board decision, ordering him to give up $468,000 in campaign money. The cash was donated to Green's campaign for governor from a fund used in his previous run for the US House. The board ruled that the money couldn't be moved, but Green says previous candidates have been allowed to do the same thing.
Green wants the State Supreme Court to take up the case directly, because the election will be over by the time he goes through the normal appeals process. But the Justice Department says that?s Green?s fault. The state said he waited for a month after the Elections Board?s original decision to file his appeal, and it only came after a Dane County circuit judge sided with the state. As a result, Assistant Attorney General Christopher Blythe says the request is not all that urgent and Green should have to go through the normal channels.
