A Fond du Lac County judge has dismissed the last of three drunk driving charges brought against former state Senator Randy Hopper. Judge Robert Wirtz this morning dropped a charge of refusing to submit to an intoxication test, saying there was no probable cause for Hopper’s arrest.
A jury last month found Hopper not guilty of operating while intoxicated and driving left of the center line. The former Senator was arrested last October after calls to 911 reported seeing his vehicle weaving over the center line on a state highway.
Attorney Dennis Melowski says Hopper took and passed three field sobriety tests on the day he was arrested. He says the case was a lot of hype that was based on very little actual evidence.

Hopper was recalled from the state Senate in an election held last summer.
