The family of a Marine whose death sparked a massive investigation at the Tomah Veterans Affairs Medical Center is suing the federal government.
The wrongful death and medical malpractice lawsuit filed in Madison Monday accuses the Veterans Administration of improperly prescribing drugs to 35-year-old Jason Simcakoski, failing to provide adequate care when he was found unresponsive, and improperly diagnosing his mental health and substance abuse problems. The lawsuit, filed by Simcakoski’s wife, seeks unspecified damages.
Simcakoski died in 2014 from a reaction to multiple prescribed drugs in his system. A report released last year faulted staff at the facility for his death, which prompted the removal of several top staff in Tomah, federal legislation and changes in how the VA prescribes medications to veterans.
