A man charged with the stabbing death of a Wausau area gas station clerk has changed his mind about his guilty plea. Derek Domke of Tomahawk says he didn’t understand terms of his plea bargain. He claims his trial lawyer didn’t fully explain all legal options available to him, but the attorney testified Wednesday that he gave proper details to his client.

Domke also claims to suffer from a mental condition that impaired his understanding of the plea, entered in October 2008 to the death of Zephyr gas station clerk Rochelle Anderson.

The victim’s father can’t wait for a final decision and is hopeful the judge will reject it.

Psychologist Dr. Robert Marcellino testified that Domke’s major depressive disorder and ADD tendencies hurt his understanding of the plea.  But he also admitted that his evaluation didn’t factor in some key police interviews and court transcripts.

The judge will accept written briefs over the next month and issue his decision in early March.
