The case against a dad who shot his son in the rear with an air gun because he was standing in front of the TV, moves forward.

The Dane County man pleads not guilty to a felony charge of child abuse, for shooting his son in the rear with an air gun. The story came to light after the 9 year old boy wrote a school essay about it, and his teacher contacted authorities. Dave Peschl's attorney, Bill Ginsberg, admits his client fired the shot. "The issue is, is he a good guy or a bad guy," says Ginsberg. "This occurred . . . and everybody who has an opinion one way or the other . . . I think might be missing the actual facts about what was the child's reaction."

The incident came to light when the 9 year old wrote an essay about it for school, and his teacher contacted authorities. Ginsberg says the boy didn't suffer any long term injury. "David used an air pistol and shot a bb that hit his son in the butt, on his pants. There's not much dispute that that occurred," says Ginsberg, who insists there was no malicious intent.
