POLICEfileA Beloit man is recovering after being shot by police while trying to elude police and fatally hitting a woman with his car in the process.

Beloit Police say they were trying to take 40-year-old Christopher Rutherford into custody Sunday night, after receiving a call about an unwanted person at a home in the 900 block of 10th Street. Rutherford was trying to flee in a vehicle and, while pulling away, police say he struck and killed 47-year-old Sheila Rosenbaum of Beloit.

Rosenbaum was also the victim in the unwanted person report.

Police fired their weapons at the fleeing vehicle, and it eventually crashed. Rutherford then attempted to flee on foot, before officers took him into custody a short distance away. Rutherford was transported to a local hospital for treatment of a gunshot wound he received from police.

This incident remains under investigation by the Wisconsin Department of Justice.
