A Waupaca man recently convicted of this fifth OWI offense is back in jail, following his arrest over the weekend for his sixth drunk driving offense. Luke J. Anderson pleaded no contest to the fifth charge on June 30th, and received a 9 month jail term. But he was given 60 days to report to jail to begin serving that sentence. Anderson was also placed on probation for three years, and is also on a probation hold pending the filing of charges in his most recent arrest. Waupaca County Circuit Court Judge Ray Huber, who handed down the sentence in the 5th OWI case, says it's not unusual to allow a convicted OWI offender time to set up a jail sentence.
Anderson, 26, was stopped at 1:00 AM Saturday. Besides facing up to six years in prison if convicted in the sixth OWI, he now also faces sentencing for probation revocation. Not dates have been set in the case, as prosecutors are awaiting the results of toxicology tests.
