A federal Appeals Court reinstates Wisconsin’s minimum mark-up law for gasoline sales.

The US 7th Circuit Court of Appeals has ruled Wisconsin Unfair Sales Act is indeed constitutional. The decision Friday overturned a lower court ruling from last year, which blocked enforcement of the 71-year-old law on the argument that it violated anti-trust laws.

The Wisconsin Petroleum Marketers and Convenience Store Association appealed that ruling. The law requires gasoline retailers to charge at least six-percent more than what they paid.

Opponents of the law argue it keeps gas prices high, but the Appeals Court judge ruled there was no evidence to support those claims.

In a statement, Association President Matt Hauser says minimum mark-up protects businesses and keeps prices competitive.
