A state appeals court says a political radio ad can go back on the air.
The Fourth District Appellate Court in Madison has suspended a restraining order that was issued over the weekend by a judge in Jackson County.
The order was for an ad from the Coalition For America's Families that targeted Democratic state Assembly candidate Mark Radcliffe. The candidate claimed that ad falsely accused him of supporting the Healthy Wisconsin plan.
The judge ruled it was likely defamatory and ordered it off the air. But the appeals court on Monday said there was no case law to support such a restraining order.
