Three Iowa County men accused of digging up the grave of a Cassville woman will not face charges of attempted sexual assault. Judge George Curry finds probable cause to bind over Alex Grunke, Nick Grunke and Dustin Radtke on charges of criminal damage to property and attempted criminal damage to property. But, citing that Wisconsin has no law against necrophilia — sex with a corpse — he wouldn't bind the three over on charges of attempted sexual assault.
Defense counsel for the three argued that the state statute for sexual assault doesn't apply in this case, that the body of Laura Tennessen is “human remains” and not a person, and that there was no threat to life or bodily security, because the woman is dead. The three men are also facing a misdemeanor charge of attempted theft.
Arraignment has been set for October 9th. The three remain free on bond.
