A Marathon County judge has thrown out a request for a temporary restraining order against a state lawmaker.

Lisa Brabazon filed the petition against her ex-boyfriend, state Representative Scott Suder, claiming he owns a gun and has hurt her before. Brabazon claimed in court to have "physical experiences" with him and said she had medical documents proving she had to have stitches from a laceration.

But Suder's attorney, Steven Gibbs, says Brabazon filed the petition only after she was charged with forgery and credit card fraud for allegedly stealing more than $3,000 from him. Gibbs says it's retaliatory and there's no imminent threat of harm or abuse.

The judge agreed that Brabazon doesn't face any immediate threat and had no good reason to file the petition.
