A Dane County judge says changes to the collective bargaining rights of state workers that were included in the budget repair bill are not in effect. Judge Maryann Sumi amended a restraining order this morning against implementation of Wisconsin Act 10 to include a declaration that the law has not been published.

The move comes after the Legislative Reference Bureau posted the measure online last Friday, creating widespread confusion over where the law stands in the process. Typically the Secretary of State must publish a law before it takes effect, but the administration had claimed LRB publication was sufficient.

The restraining order was issued as part of a lawsuit from the Dane County District Attorney, which claims the committee that advanced the budget repair bill violated the open meetings law. Testimony in the case continues Friday.
