A judge has put off a decision on whether to remove a child safety plan as a bond condition for a rural Weston couple charged in their diabetic daughter's reckless homicide Easter Sunday.

Dale and Leilani Neumann's are charged with first degree reckless homicide, after their 11-year-old daughter died of untreated diabetes. Police say the parents prayed for their daughter's recovery, rather than seeking medical treatment for her. Their three surviving children were taken into protective custody shortly after their daughter's death. They were returned to their parents, under a bond condition that required a safety plan to make sure they received medical care if needed.

Both sides admitted Tuesday morning that the plan is no longer in effect after a judge dismissed a legal matter involving the protection of Neumann's three surviving children. Still prosecutor LaMont Jacobson argued some type of plan is necessary to protect their health and well being.

However, defense attorney Gene Linehan argued there is no need of protective services for the children. Linehan says the children should be allowed to handle their own care.

Both sides have until Wednesday afternoon to come up with a modified plan.
