A new attack on Governor Doyle's proposed tax on Big Oil.
A legal opinion commissioned by the Wisconsin Motor Carriers Association finds a "no pass through" provision in the Governor's plan would likely be declared unconstitutional. Association President Tom Howells says that's been the case elsewhere, such as a law in New York that had a similar provision struck down.
The report was prepared by the Foley and Lardner law firm.
The oil tax is still in the governor's budget bill, but is expected to be removed by the Legislature's Finance Committee. Doyle has also said he's open to alternatives.
