A judge has set sentencing for one parent in the Weston prayer death case, while finalizing trial preparations for the other.

Marathon County Judge Vincent Howard has set Leilani Neumann's sentencing for October 6th. A jury convicted the Weston woman last month of reckless homicide for choosing prayer over medicine as her daughter died from diabetes last year.

Meanwhile, Howard says Dale Neumann is entitled to a local jury when his trial begins next month. But he wants lawyers to file briefs on whether the law allows him to delay the trial date or where the jury comes from.

Prosecutors are requesting that the trial be delayed and the jury picked from another county, to prevent publicity from the first trial from influencing the outcome. Dale Neumann's defense attorney says his client wants to the trial to go forward as planned.

The judge also had to re-affirm a gag order in the case, preventing anyone from discussing it outside of court. The order came after prosecutors alleged that Dale and Leilani Neumann posted comments before, during and after Leilani's trial on a Web site.
