A legal setback for the Mark Green campaign; a Dane County judge has denied Green's request for a temporary injunction that would have prevented the state Elections Board from enforcing last week's ruling that Green would have to divest his campaign of some $468,000 from political action committees. Green campaign manager Mark Graul says the decision by Judge Richard Niess was not unexpected. “We expected, based on what the judge was saying on court on Thursday, that he believes this is matter best decided by a higher court.

Graul says the campaign hopes the judge's decision can be appealed directly to the Wisconsin Supreme Court. He adds that the disputed money will be out of reach, for now, in a separate account. Graul says Judge Neiss said it is federal elections law that is at question — something he says the state Elections Board didn't even consider in its ruling against the Green campaign.
