Attorneys representing the Government Accountability Board are asking a judge to drop a lawsuit challenging a new state ballot design.

Republicans claim the new ballot layout gives preference to Democratic candidates and could confuse voters. They want a judge to allow local clerks to use alternate ballot designs.

Attorneys for the state argue the case should be dropped because lawmakers failed to take their complaint directly to the GAB or ask a prosecutor to investigate the issue, which are the options required under the law before a legal challenge can be filed in court. They also claim Republicans have not shown how the ballots harm them directly.

The case is scheduled for a hearing Wednesday morning in Waukesha County circuit court.
