Bail set, charges expected against State St. shooter

May 25, 2007 By WRN Contributor

Cash bail of $100,000 has been set for Daniel Kelly of Madison . He's the man accused of shooting and killing Austin Bodahl of Minnesota Tuesday night during a fight on State Street. No formal criminal charges have been filed. Prosecutors say police are still trying to figure out what prompted the fight and whether the shooting was self defense. Assistant Dane County DA Lana Mades said the state is expected to file a charge of first-degree reckless homicide Tuesday. She describes Kelly as an unemployed military veteran with a history of mental health issues. He was off of his meds at the time of the shooting, according to Mades. She also says he has a history of trying to flee the country. Public Defender Dennis Burke says Kelly has ties to Madison. He grew up here. He graduated from high school here. He says Kelly is not a flight risk.
